The Art Kid Experience | Terms & Conditions

Effective Date: November 1, 2026

These Terms & Conditions ("Terms") govern participation in The Art Kid Experience, offered by Art Kid Collective ("AKC," "we," "us," or "our").

By submitting artwork through The Art Kid Experience submission form, the participating parent or legal guardian agrees to these Terms.

1. Eligibility and Parental Authorization

The Art Kid Experience is intended for the winning recipient of the PS38 PTA auction prize.

The submission form must be completed by a parent or legal guardian who is at least 18 years old.

By submitting the form, you confirm that:

  • You are at least 18 years old.
  • You are the parent or legal guardian of the child whose artwork is submitted.
  • You have the authority to authorize the use of the submitted artwork for this experience.
  • You have read and agree to these Terms & Conditions.

2. What's Included

The Art Kid Experience includes the creation of four (4) personalized garments featuring one original artwork submission:

  • One (1) adult hoodie
  • One (1) kids' hoodie
  • One (1) adult T-shirt
  • One (1) kids' T-shirt

The experience includes artwork preparation, garment production, and standard shipping within the United States at no additional charge.

The prize has an approximate retail value of $147.80.

The prize cannot be exchanged for cash or redeemed for store credit.

3. Artwork Submission

Participants may submit one original drawing created by their child.

The artwork may be newly created or an existing drawing.

By submitting artwork, you confirm that:

  • The artwork is an original creation of your child.
  • You have the authority to permit its use for this experience.
  • To the best of your knowledge, the artwork does not infringe upon the intellectual property rights of another person or organization.

Artwork containing copyrighted characters, trademarks, logos, or other protected material may be declined or require modification.

AKC reserves the right to decline artwork that cannot reasonably or lawfully be reproduced.

4. Artwork Ownership and Permission to Reproduce

Your child retains ownership of their original artwork.

Submitting artwork does not transfer copyright ownership to Art Kid Collective.

By submitting the artwork, you grant AKC a non-exclusive, royalty-free, limited license to:

  • Prepare the submitted artwork for garment printing.
  • Reproduce the artwork on the four garments included in The Art Kid Experience.
  • Create digital product previews necessary for the participant to view and select their garments.
  • Share those previews privately with the participating family.
  • Provide the artwork to production and fulfillment partners solely to complete the experience.

This permission is limited to fulfilling The Art Kid Experience.

AKC does not receive permission to sell products featuring the artwork to the general public under these Terms.

Any future commercial collaboration or product sales would require a separate agreement.

5. Artwork Preparation and Production

AKC will prepare the submitted artwork for garment printing.

Preparation may include:

  • Removing paper backgrounds.
  • Cleaning up scanned images:
  • Adjusting image resolution.
  • Removing unwanted marks or artifacts.
  • Making technical adjustments necessary for printing.

AKC will make reasonable efforts to preserve the original character, colors, and creative expression of the child's artwork.

Minor differences between the original drawing, digital previews, and finished garments may occur because of printing processes, fabric textures, and garment colors.

The experience does not include a formal artwork proofing or approval process.

6. Garment Selection

Once the artwork has been prepared, AKC will create a personalized collection featuring the four garments.

The participating parent or guardian will receive instructions for viewing the collection and selecting their preferred available colors and sizes.

Selections will be communicated to AKC through a shared wishlist or another method provided by AKC.

Garments may be selected for the participating child, family members, friends, or other recipients.

The prize is limited to the four garment types and quantities described in Section 2.

Additional garments or substitutions are not included.

7. Production and Shipping

Once garment selections have been received and confirmed, AKC will arrange production and fulfillment.

All garments are made to order.

Standard shipping within the United States is included.

Production and delivery times may vary depending on garment availability, printing requirements, and shipping conditions.

AKC will make reasonable efforts to communicate significant delays.

8. Returns, Exchanges, and Product Issues

Because the garments are personalized and made to order, returns or exchanges for changes of preference, including selected colors or sizes, are not available.

If an item arrives damaged, defective, or materially different from the confirmed selection, please contact AKC within 14 days of delivery.

AKC will review the issue and, where appropriate, arrange a replacement or another reasonable resolution at no additional cost.

Nothing in these Terms limits rights that cannot legally be excluded.

9. Privacy and Personal Information

Information collected through the submission form may include:

  • Parent or guardian name.
  • Parent or guardian email address.
  • Child's first name.
  • Submitted artwork.
  • Consent and submission records.

This information will be used to administer The Art Kid Experience, communicate with the participating family, prepare the artwork, and fulfill the prize.

Information necessary for production and delivery may be shared with service providers involved in fulfilling the experience.

AKC will not publicly identify the participating child or publish the submitted artwork solely on the basis of accepting these Terms.

Personal information will be handled in accordance with the Art Kid Collective Privacy Policy and applicable law.

10. Optional Promotional Permission

Participation in The Art Kid Experience does not require permission for promotional use of the submitted artwork.

Parents or legal guardians may separately choose whether to authorize AKC to feature the artwork and resulting garment designs in its website, social media, email communications, advertising, or promotional materials.

Any such permission must be provided through a separate, optional consent selection.

Declining promotional permission will not affect eligibility, participation, or fulfillment of the prize.

Promotional permission does not authorize AKC to sell additional products featuring the artwork.

11. Future Artist Collaborations

AKC may offer opportunities for children's artwork to become part of future Art Kid Collective collections or fundraising initiatives.

Participation in these opportunities is entirely optional.

Expressing interest in a future collaboration does not grant AKC permission to sell products featuring the artwork.

Any future commercial use, including product sales and revenue-sharing arrangements, will require a separate agreement with the appropriate rights holder or authorized representative.

12. Changes and Availability

AKC may make reasonable adjustments to production methods, fulfillment arrangements, or garment options when necessary due to availability or circumstances outside its control.

If a specified garment becomes unavailable, AKC will communicate with the participating parent or guardian regarding an appropriate comparable alternative.

Any material change to the prize will require the participant's agreement.
